Historic violation of Constitutional provisions needs to be corrected
Leader of Opposition in the Delhi Vidhan Sabha, Vijender Gupta today submitted a memorandum to Lt. Governor Sh. Najeeb Jung at Raj Niwas seeking his intervention in the matter of unconstitutional nomination of 13 AAP MLAs to the three Municipal Corporations of Delhi. He said that no MLA can be nominated again. But Delhi Assembly Speaker, Sh. Ram Niwas Goel has repeated 10 MLAs out of the 13. He urged that the historic violation of the Constitutional provisions needs to be corrected immediately.
Gupta urged him to advise the Speaker that the Constitutional Provisions as laid down in the DMC Act are strictly adhered. He demanded that the Speaker must withdraw the nominations already done. He requested LG to impress upon the Speaker to nominate only those MLAs who have not been represented so far in the municipalities. BJP MLA Sh. Jagdish Pradhan was also present.
Leader of Opposition later informed that LG assured him he would ask the speaker to examine the issue afresh and take appropriate action in the light of the objections raised by the Opposition.
Leader of Opposition pointed out to LG that Delhi Assembly Speaker Ram Niwas Goel has grossly violated the Delhi Municipal Corporation Act, 1957 (Amended 1995) in the matter of nomination of 13 rulings MLAs as MCD members of the three Municipal Corporation – East, North and South Delhi. Five MLAs each have been nominated to each South Delhi and North-Delhi Municipal Corporations - while three MLAs have been nominated to East Delhi Municipal Corporation.
Mr. Gupta submitted that it is surprising that contrary to the existing Constitutional provisions as stipulated in the aforesaid Act, out of the thirteen MLAs nominated as members, 10 MLAs have been repeated this year. It is all the more surprising that all the five nominated members were repeated in case of SDMC.
Leader of Opposition pointed out that the sections 3. [(3)(b) (iii)] ofDelhi Municipal Corporation Act, 1957 (Amended 1995) clearly lays down that all the MLAs are rotated in five years and no MLA is repeated. But the AAP Government has thrown the Constitutional provisions to wind and re-appointed 10 MLAs out of 13.
